Title: Claim for Talaq

Question: A couple had an argument and the man beat his wife but now the wife claims her husband divorced her thrice. But the husband rejects her claim and he says I am ready to take oath that I did not divorce her. But the husband's sister witness that the divorce happened thrice. But the man still urges that he did not divorce.

(Fatwa: 983/913/N=1434) In case there is difference between husband and wife regarding talaq and the woman claims for talaq while the husband rejects it, then both of them should consult Darul Qaza or Shariah Panchayat for the solution of their problem. However, if the woman is sure that her husband has given her three talaqs as she heard it herself or through some reliable person then it is not lawful for her to give her husband control over her and live with him like wife.
