- Q. I am a local musalli of a masjid in my area and would like to have the following clarifed. We had an imam appointed at our masjid who as part of his salary was given the liberty of staying in a property that the masjid owns, with his family at no charge. the issue now is that the imam has left his employment. However as the property is owned by the masjid and was to be used only for imams, due to him no longer being employed as the masjid's imam, it was part of his contract that he vacate the premises on leaving his post. the individual in question has refused to do so and on trying to reach an amicable agreement with him, the masjid committee stated that they would allow him and his family to continue living in the property owned by the masjid if he provided a reasonable rental sum every month. to this also the imam refused and at present has been living in the property rent free for a few months. 1. please could you let us know what the ruling is for such a person (imam) in light of the Qur'an and Sunnah. 2. What would the best course of action be to resolve this dilema? 3. Many local scholars and learned people who are aware of this situation have stated through reference to religious texts (I cannot remember exactly which ones as I am not myself a scholar) that the leading of salah by such an individual described above is makhrooh tehreemi. Is this correct?

I have asked a question no is 5417 which i have got reply, but i wanted to tell that i person who is loking after work of masjid is not an employee of waqf commite .kindly answaer again question no 5417 is as fallows.... i am sameer deshmukh from gwalior,my matter is that there is a mosque in my neighbour where i offer namaz going regularly to masque i found that waqf commitie members has given permission to a non muslim to do all kind of work like wise collecting rent from shops of masque,giving sallary to imaam,cleaning water tank and other important work like mantaining all expenses records.but when i questioned to the waqf commitie they said there is no harm.and when i asked for expense statement they said you have no right to see the records we will show it to state waqf board and to allah only.please guid me from quran and hadit that such work of masjid be done by a non muslim or muslim ,and can a person see expense record of waqf commitie.

- Q. In my village, there is a Eidgaah where we perform both Eid and Baqr-Eid Prayers. But the large number of people cannot perform in it because it is too small. And also there is no room at both the sides so that it can be extended. So we want to know that can this Eidgaah be sold and another land can be bought. Or can it be exchanged with another land? My question is that in our locality three sisters own a plot of land and it was agreed that the two sisters will not claim their right in the property on payment of considerable amount to be paid by one of the sister. However, the sister did not make any payment to the other two sisters but rather built a Mosque on the said plot of land. Regular prayers are offered including Jumah and also Jammat stay in the said Mosque. The matter has reached to the Court and till date the matter has not been compromised nor any payment was made. KIndly reply in the light of Quran and Hadis whether it is proper to offer prayers in the said Mosque and what is the status of the said Mosque and what steps should be taken by the sister who is to make payment so that the matter could be compromised.

I am the Secretary of Darul Uloom Jamea Siddiquia, Ponda (Goa).We have been doing Hilah of the donations received for our Madarassa, in the forms Zakat, Attiya, Sadaqua etc once a year in the beginning of the our academic year. Please advise whether such Hilah is required to be done periodically as and when such donations are received by us.

We would like to ask a Shari Ruling regarding rent for a Madrasah which is based at an Islamic Secondary school building, the Islamic Secondary school building was opened by the current Chairman and the current Vice Chairman (a committee was later made on the bases that they would be supportive). Currently the Madrasah uses three classes in the evening for Madrasah. The Madrasah currently pay?s rent. But the issue has arisen about rent for the Madrasah when it first opened in 2004. Before the Madrasah opened, eminent scholars gave Mushwerah that the building was not used in the evenings and it would be suitable for evening Madrasah, through this it was then decided by the Chairman that the building can be used without any rent being paid, this was due to the Madrasah being new and to get the Madrasah running, at this time none of the Governors of the school were active in the daily issues of the school. From 2006 due to some issues (regarding the Islamic Secondary school) the Governors of the school got involved and they raised the issue of rent and they decided that rent should be back dated to (2004) and paid to the date of when payment first started (which was 2006). According to Shariah is it compulsory to for the Madrasah to pay the backdated rent?

- Q. One arab muslim owns one mosque as his personal property. Imam is from Azhar and Azhar pays him salary. Problem is owner prays five times a day but his wife is an american christian. They married a long time ago but She did not accept islam and is continously in christian faith. Owner is getting old. If he dies the property goes to his wife. Suppose at that time if she allows muslims to pray in the mosque as usual. Then question is whether muslims are allowed to pray in the building owns by a christian or not. At this point owner refuses to transfer the building to the muslim community. Muslim community is very small and they do not have resources to buy an other building for mosque that cost lot of money.

We are working in Saudiarabia and we collected some money from all our friends on monthly basis to server the village grave(Kabirstan work)place and other charity activities like help poor etc... Presently we kept money at village and if any one of us urgently need some money at back home we give to their relative on the bank conversion rate but we charge them 5 riyals more on each 100-500 riyals and they need to pay after a month time. Is it permissible on islam to accept this money and can we utilize this money further for contribution to build or repair mosque or any other activities?
