- Q. I hope Insha Allah, you will be able to advice in the right direction. Please look into the following case: One Mrs. XYZ sought Khul from her husband Mr. ABC after eight years of marital life. Mr. ABC approved the request for Khul of Mrs. XYZ and Khul took place. Before the Idda period was over, the woman XYZ realized her fault and requested again for Nikkah, which the man ABC has accepted. They got remarried as per the Islamic Sharia. Within 3 months of remarriage, the Husband Mr. ABC realized and warned her that she is not obedient and not behaving properly as a wife. Finally after a few days, the Husband ABC divorced her (XYZ) during Tohar condition one time for not fulfilling the marital requirements. Before the Idda period came to an end, the wife repented and they reconciled and got united again. Again after 5 months, Husband ABC divorced Mrs. XYZ for her not obedient attitude and for not fulfilling the marital requirements. Again the wife Mrs. XYZ said, she will try to be following the marital requirements of a wife and they got reunited again. Again after reunification, the same problems surfaced again. Now the husband wants to diverse her again. Now the question is if the Husband divorces now in Tohar condition, is it considered as first Talaq, or the Third talaq?

I would like to give you the complete details so as it will be easy for you to give me the answer, the below is are the details, I am a 30 year old male and I am employed in Jeddah, Saudi Arabia. For my marriage my parents were searching for girl last year and at last they found a girl who is the daughter of my father's friend's sister i.e bhanji of my father's friend. When asked by my family they provided the photograph and also sent me the same and I approved. The girl's family told my parents the date of birth of the girl as 02-09-1980 and finally I was married to this girl on 5th January, 2007 with a mutually agreed Meher of rupees 1 lakh. After my marriage I spent exactly 28 days with my wife and after that I returned to Saudi Arabia....

- Q. I was married on Feb 16,2003 and came back to Arab for job to-date I did not go to India due to my job and passport problem. Allah bless us baby boy on Dec 20,2003. In Feb 2004, I lost the job and my inlaws started blaming me that I am married in Saudia. I sent to my wife money several times till June 2004 but after that she refused to take money, the reason was wrong concept of my marriage. After that she left the town and settled in Delhi without my consent and started Diploma in Beauty Parlor course. She came back again to home town in her mother home in July 2005, then I sent her money but she again refused. In Dec 2005, she left to Pakistan without my consent and came back after several months. In July 2006 she called me very nicely I pardoned her and we started talking till Aug 26, 2006. On Sept 13, 2006, She left to Africa along with my three old son without informing me. Her African uncle promised me to send wife/ son to me. She talked nicely from Nov 7 to Dec 2 2006. And suddenly she filed a in Jamiat Ulema Africa for Khula. The main point the wife raised that I am not in touch with her for three years and neither send her money. (Is her maintenace claim valid if she is running here/there in different countries without informing me). They are denying any conversation between Nov 7,2006 to Dec 24,2006 by saying that the voice can be developed on computer in fraud way. The last money I sent her on Aug 6, 2005 because after that she refused to accept. She want to keep son with her. My question is that on this ground our nikah will remain valid or it will finish. I want my wife and son with me as per Quran/ Sunnah.

A husband made a petition to the English court asking the Judge to issue a Legal Divorce on the basis that, * the husband had lived apart from his wife for a continuous period of at least two years immediately preceding the presentation of the petition, and * the wife consents to a divorce being granted and * that the marriage has broken down irretrievably. If a Judge holding the above reasons issued a divorce, when the truth of the matter was that all these basis were completely untrue, will the divorce issued by a Judge be valid according to the Shariah?

- Q. I just want to know if in this condition talaq is effective: One day before meet my wife I wrote in paper: "I Salim give talak to you Salma". I wrote three times in same paper. When I met her I give verbally 3 time Talak, but she is saying that I only gave two time. - I gave her the paper, she refused to receive and the paper fell in the ground. After she left I send SMS, with same text of the paper. She said that she never read because her mother deleted all the SMS. The paper and the SMS (in my cellular) at least 3 people read. In this condition talak is valid? Please send answer, with Quran and Hadith proof.
