- Q. Assalamualaikum, When my father was alive we had one house. Now he has died. Now we have purchased one more plot. My father had three sons and one daughter including me and my mother is also alive. When my father was alive he used to say that he will give the house to my Brother who is Hafeez and Aleem where as we were studying and he was hopeful of we getting good job and salary. Now the issue is do we need to give this house to my Brother who is hafeez and aleem or distribute it as per Islamic Shariat. Kindly answer this in light of Quran and Hadees. May Allah reward you.

- Q. Assalaam Alaikum, A Man dies leaving behind a wife and two daughters from the wife.He has left behind him some self aquired property. After his death , his brother's sons ( bhatijay ) have demanded a share from the property,even though their father, i.e.; the deceased man's brother died much before him. Earlier, during the deceased man's lifetime, these nephews demanded a share in his property claiming joint ownership of the business between their father and the deceased man.However, the same was rejected in a court of law , by virtue of proofs,evidences and records. Is this claim , now,by the nephews, allowed?,even after the death of their father? Are the nephews entitled to any share of the inheritance from their uncle's ( deceased man )property in the absence of their father? The deceased man did not have any liking for them during his lifetime as they embroiled him in unnecessary and unwanted legal controversies. Your answer in this regard shall be highly appreciated.

A man Abdul Wahab had 4 children, 1 son named Idris and 3 daughters. He has a common property. Abdul Wahab and his wife passes away. NOW THE PROPERTY DOCUMENT IS NOT TRANSFERRED TO THE 4 CHILDREN. THE PROPERTY IS STILL IN ABDUL WAHAB's NAME. Son Idris looks after the affairs of this property. Now the son Idris also passes away. Idris has 5 sons, 4 daughters and 1 Wife. So now when the legal heirs of Abdul Wahab wanted to divide the property, the 3 daughters of Abdul Wahab take One share each and leave 2 shares to rest with the deceased Idris family. Now my question is, a. what is the ratio at which Idris share is partitioned among his wife and Children ? b. Who are the legal heirs of Idris ? c. If Idris's wife has a share ? As the property in question is not on Idris's name but of his father. Please reply this question as soon as possible as some family members makes an issue whether to give a share to the mother. My grandfather has 3 wives not at the same time but one after the other?s death. 1st wife has no child dies very early year not known ,2nd wife had 1 son (i.e. my father ) and 1 daughter , 3rd wife had 3 son (i.e. my uncles ) and 3 daughter s My 3rd grandmother (i.e. step grandmother ) dies on 1996 which has 1 property in her name and rest all in grandfather?s name . My grandfather has gifted 1/4th property to me which is written on plane paper no legal value as I hope excluding that property which is in my grandmother?s name as he told me that this property should be distributed among his 4 daughters . How much share should I and my 3 sisters get from my grandfather?s property and what does Islamic Inheritance Law of India said about the grandchildren share whose father dies before his grandfather or what is Indian Law said or which law is applied to my case . My mother dies in 1986 and her father (i.e. maternal grandfather ) after amonth of my mother?s death leaving 1 wife (i.e. my maternal grandmother ) and 2 daughters ( i.e. my aunts) My grandmother orally said that ? Question is how much share we get from maternal side condition that my mother dies (1986) before maternal grandfather and father in 1997 after my maternal grandfather (i.e.in 1986). - Q. ASA After my mothers expiry my father married again.After sometime he planned to build a house at Karachi,while he was posted at Lahore. To facilitate house building loan the plot was transferred to her name. Later my father built two more floors & directed me to come & live with him,declaring that the 1st floor was for me. Then I moved up-country as per job requirement & the 1st floor was rented out,while family of my foster mother's sister moved in & occupied the 2nd flooor. My father expired recently & it seems my foster mother intends to deprive me from my father's property & eventually hand over its custody to sons/daughters of her sister residing on the 2nd floor. This is so because my foster mother is issue-less. Nothing was contributed by my foster mother towards construction of the house,she was & is merely a custodian. Legally I cannot proceed against her as per the law of the land, or is there any access to justice through SHARIAT-E-Islami? Plz. intimate earliest as to what I should do?

- Q. My father in law died, leaving a 10 marla house , a car and defense saving/national saving certificates worth 24200000 Rs. He has only one daughter. He left behind a widow (second wife) with no children (she isn?t pregnant). His only daughter is from first wife, who (the first wife) died in my father in law?s life. He (my father in law) also had five brothers and four sisters of whome a brother and a sister died in his own life.Now remaining are four brothers and three sisters alive, one of the sisters is from step mother of my father in law (But same father). My father in law, in his life, announced (written form) his only daughter as ?NOMINEE? for certificates and house. My father in law?s parents had also died in his life. Kindly provide us a fatwa in accordance with Quran and Sunnah regarding distribution of assets which he (my father in law) left behind.Just for your kind information the deceased and we all belong and follow Hanfi School of thought.

- Q. Assalamu alikum Iam 76 year old muslim.I have 8 childrens totally. 4 men and 4 women. As per islamic law and indian custom i have completed my 4 daughters marriage in a grand manner(with 500 gms gold). My three son have been married and my younger son is a bachelor(till now).Me and my wife live with my sons.We all live togather in my own earned house.My sons cleared my debts when i lost my business.I gifted my house only to my 4 sons because this is the only place where my sons and my daughter-in-laws(with their childrens) live and they take care of me and my wife.Is this correct according to Islamic law. please clear my doubt.
