    Title: Will zakah be paid if poor and needy ones are fed in the mosque?

    Question: Does feeding fellow brothers and sisters at a mosque count for zakah? Many of which come from poor families but not all.

    (Fatwa: 1135/1146/N=11/1437)

    Zakah shall not be paid by feeding poor and needy ones in the mosque or somewhere else as tamlik (giving in the possession of poor) is a condition for the payment of zakah, while the condition of tamlik is missing in case of feeding on dining table as only it is permission (ibahat) to eat. However, if poor and those eligible for zakah are made owner of the food with the intention of zakah then zakah shall be paid equal to the price of food.

    قال الله تعالى: إنما الصدقت للفقراء والمساكين الآية (سوره توبه آيت: 60)، وقال الحصكفي فى الدر (مع الرد كتاب الزكاة ، باب المصرف 3: 291 ط مكتبة زكريا ديوبند): يصرف المزكي إلى كلهم أو إلى بعضهم، .......ويشترط أن يكون الصرف تمليكا لا إباحة اهـ ، وفى الرد: قوله: "تمليكاً" : فلا يكفي فيها الإطعام إلا بطريق التمليك ، ولو أطعمه عنده ناوياً الزكاة لا تكفي ، ط اهـ.
