    (Fatwa: 1029/1052/N=10/1437)

    (1, 2) Only poor and needy Muslims are eligible for wajib sadaqah i.e. zakah and sadaqah al-fitr etc. provided they are not Sayyids. Zakah and Fitrah cannot be given to a non-Muslim whether he is poor. However you may give him help and gift etc.

    ولا تدفع إلى ذمي لحديث معاذ (الدر المختار مع رد المحتار ، كتاب الزكاة، باب المصرف 3: 301، ط: مكتبة زكريا ديوبند)، فى المحيط من كتاب الكسب: ذكر محمد فى السير الكبير : لا بأس للمسلم أن يعطي كافراً حربياً أو ذمياً وأن يقبل الهدية منه لما روي "أن النبي صلى الله عليه وسلم بعث خمسمائة دينار إلى مكة حين قحطوا وأمر بدفعها إلى أبي سفيان بن حرب وصفوان بن أمية ليفرقا على فقراء أهل مكة" ولأن صلة الرحم محمودة في كل دين، والإهداء إلى الغير من مكارم الأخلاق الخ (رد المحتار ، 3:302) وانظر رد المحتار (أول كتاب الوصايا 10: 345، 346) أيضاً.
