    Title: Can I give my zakah to my brother who is a university student? I am a Govt. employee and I want to give my zakah to my brother

    Question: Can I give my zakah to my brother who is a university student? I am a Govt. employee and I want to give my zakah to my brother. Our father is dead and my mother monthly pension is not sufficient. I am responsible for his educational expenses as I am the eldest brother and the others have no job. We 4 brother share agricultural land but it rarely produce any crops. Can I give my all zakah to him roughly about 15000 Pak rupees per annum?

    (Fatwa: 27/14/N=1433) If your brother does not possess wealth more than his necessity that makes him owner of nisab as per the Shariah and he is not a Sayyid then you may give him your zakah, zakah shall be paid provided he is made the owner of the zakah money (Kifayatul Mufti 2:275). If he is not made its owner and you paid your zakah money as his fees etc then zakah shall not be paid. He should not be given as much zakah that he turns owner of nisab as it is makrooh: قال فى الدر (مع الرد كتاب الزكاة باب المصرف 3 : 291) : ويشترط أن يكون الصرف تمليكاً اهـ وفي ص 303 منه : وكره إعطاء فقير نصابا أو أكثر ..... اهـ وفى الرد تحته : .... وبه ظهر أيضا أن دفع ما يكمل النصاب كدفع النصاب اهـ
