    Title: AA. about rebuild of very old and small masjid. for the many reason have to replaced and rebuilded a new big mosque nearby old mosque (approx 3 fit far).after demolish the old mosque land is empty now and next to busy road is it parmissible to do some shops on this empty land for the benefit of the mosque? massalam

    After demolishing the old mosque, the mosque was rebuilt by leaving three feet area, so if the left area was a part of Sharai Mosque, it was unlawful exclude it from mosque and construct shop etc over it. A portion of land, once included in Sharai mosque, will always remain mosque and it will be unlawful and haram to dislodge it as mosque. Yes, if the portion (3 feet) was already out of Sharai mosque, so for the interests of the mosque, shops etc can be constructed there with mutual consultation and consult the local Ulama for observation and survey.
