Title: My brother in law married to a girl and after staying together for more than 03 yrs. Unfortunately separated by signing a document signed by both.

Question: Without verbal use of word talaq since then both staying away for more than 6 years. Now both want to reunite and want to live together. Please clarify in the light of Quran and Shariah whether the talaq holds good or not or nikah is still valid so both can live together as husband and wife.

Bismillah hir-Rahman nir-Rahim !

(Fatwa: 5/6/D=01/1436) If he did not utter talaq or such a word which terminates nikah and did not write any word like this on paper then merely by signing on blank paper talaq did not take place, their nikah is intact. It is lawful for both of them to live like husband and wife together.
