Question: When I got marriage there were bride, bride groom, Qazi, one young man and one young lady. Is this marriage ok? If there are one man and one woman witness then is the marriage ok, though Qazi is available to complete the procedure? Can a Qazi become a witness? If the marriage is not ok, what is the solution as per Shariah?

(Fatwa: 1666/1143/L=1432) (1) In the said situation, since you were present at the time of nikah hence nikah took place and you became the solemniser of nikah and the Qazi and other male shall become witness. (2) At the time of nikah, if there is one male then nikah is valid provided husband and wife are present at the time of ijab-o-qubool (proper exchange of nikah words). (3) A Qazi may become witness when the husband and wife are present. لو زوج الأب بالغة عند رجل واحد إن حضرت البالغة صح لأنه إذا حضرت صارت كأنها عاقدة والأب وذلك الرجل شاهدان والا فلا يصح . مجمع الأنهر : 1/475)
