The witness can be anyone who is aaqil (sane), baaligh (adult) and Muslim. It is not necessary for a witness to be from immediate relatives. However, there should be two witnesses who can listen and understand the Nikah words that are exchanged by a man and woman:

ولاینعقد نکاح المسلمین الا بحضور شاھدین حرین عاقلین بالغین الخ (ھدایہ)

Q. In continuation with Question #: 16005 Respected Maulana, Assalamualiakum Wa rahamatullahi barkatahu, I am in very great trouble now. The girl whom I got married is having an affair with someone. Due to this she had asked me many times to give talaq. Since I did not knew that she loves someone I had ignored this. She has clearly written in one letter and also told me about this later. She has taken all jewelry give by us. I do not want to spend rest of my life with a liar who does not fear Allah and the Day of Judgment. Please help me. In eleven months of our marriage she hardly stayed with me for 2 months. Please let me know what will be compensation I should give? Will I get back the jewelry (not mahar) give by me?
