- Q. My grandfather was started business with his two sons (my father & elder brother)before 50 years. Both were done very very hard work with my grand father. My father elder brother is a educated person and my father is a non educated person. So after few year my grand father out of business, and my father elder brother hold all business and doing hard work, because he is able to do all business activites. And my father was also with him but not a very active person. But now my father elder brother is saying, my father is not a real business partner and all groth are done by myself. And he also not accepting a business partner. would you tell me my father is partner or not and his also 50% partner of all business & assest or not.

- Q. June 19, 2009 Assalamualaikum Wo Rahmathullahi Barkathahu, My name is Mohammed Safiulla from Bangalore, India. Kindly let me know the Fatwa in light of Quran and Sunnah. My Father in law passed away last year. May Allah reward him with a place in Jannathul firdose. Amin. Summ Amin. My deceased Father in law has two sons-one married and the other a bachelor and one daughter who is also married. I would like to know how the property that used to be owned by my deceased father in law need to be distributed. My mother in law is alive and she is taking the family pension. Also let me know whether the children have any rights in the deceased?s pension also. Also my deceased father in law has got some ancestral property from his father. Kindly let me know whether the grand children (two grand sons and a grand daughter) have got any right in this property. Please note that there is no WILL on any of the properties by my deceased Father in law. Your earliest reply would be highly appreciated.

- Q. Assalamualaikum Brother A friends mom want to write a will and give away all her wealth to a cancer charity in canada.The whole family is muslim. She has three daughters aged 22, 20 and 7. My question is that can the mother give away all her wealth in charity after she dies or even while she is alive? If the mother has permission of her two adult daughters, can she give it away then, minus the share of the little sister? Would it be okay for a muslim lady to give everything to a charity in canada instead of helping people here in pakistan where she normally resides? Is it okay for Muslims to give charity to christian or any other organisations besides muslims'? If the mother does write this will and give away everything to this cancer charity in canada without consulting with her daughters, would she be held accountable on the day of judgement, i mean is that a sin? Also please keep in mind that her husband is well off too and the mom generally has a tendency to help the needy, so please let me know whats the best possible option for her knowing that she has always wanted to help the poor and the needy. - Q. assallamalaikum, we are mother, 5 brothers & 3 sisters my father expired in 2001, during his life time he owned many properties some ancestrial and some his own purchased. he during his life time i.e. 1994 transferd a portion to the extent of 10 acres out of his own purchased 12 acres land in equal proportion to all his 5 sons and handed over the possesion to his five sons, remain 2 acres still exsists in his name. my question is wether my sisters are claiments to this perticular 10 acres land ? or as to how do we do with this perticular land as per sharia?

- Q. Assalamlikum Provide me fatwa on my property distribution to my children. I have 4 sons & 2 married daughters. All property is in my name & my wife also alive. Property distribution in my life time as I knew divide the property into 6 equal parts and give each part to every one. But I want to distribute my property less or more (adjustment) way (not equally). Those (son or daughter) who is financially week or not good condition or other reasons etc.. I want to support them. Myself & my wife intention is very clear to look all children equally & wish all our children well settle & happy in the life without any discriminates or depriving in any son or daughter. Can I do like above it is correct under Islamic rules? And one more thing I want to know about GIFT GIVING RIGHT. Can I give gift some part to one son or daughter or other. Is it correct?

- Q. assalamwalekum, respected n knowlegeable ulema's, this is to ask my mothers right to her fathers property. my grand father (nana/mothers father ) were 2 brothers n 5 sisters. he married twice had 3 kids from the first wife who died long ago but the second wife doesnt have any kids and is a widow. my mother is the youngest of 2 brothers .one died in 2000 in U.K he was a doctor there he left behind his wife and 4 sons all residing in the UK. my mothers elder brother is a divorcee with no kids and still alive. my grand father left behind vast immovable and movable property in form of residences farms money cattles land holdings fire arms etc etc. without any will . ill be highly obliged if u instruct us in the division of my mothers ancestral property which was in the name of my grand father or earned by him . plz give us the division details according to the sharia law as well as indian law for muslims if any as such present. helping us in this matter will solve our long standing problems in our family. thanking you with warm regards!

- Q. Asalam alaikum, My eleder brother expired two years ago leaving behind a wife and a minor child. After some period of time recently, the widow (wife of deceased) got remarried. In this point of view we went to Darul Ifta in Hyderabad to know the Sharia Law for the child custody in such situations. They gave us saying that the Child if female shall be with mother and if male then after her remarriage the child until the age of 7 should be with the maternal grandmother if she is alive and later after 7 to the paternal grandparents if she is not alive then the custody shall be for the paternal grand parents. Now the problem is we have been seeking from the widow the custody but they are reluctant to give when we show them the fatwa they told us to keep it aside and they want to have the share from the property (the share of the widow). we have no problem in giving the share we evaluated as be the sharia law and gave the figure how much will it be and later they keep on delaying things with the intention to avoid the cutodial issue of the child. Until now the issue is pending so far we havent seek any assistance from the court. we would like to seek your kind assistance is doing the rightful. Please guide us, and show us path to safegaurd the childs mental conditions as t he mother (widow) took the child with her to his new husband. Guide us how can we enforce the sharia law, the fatwa issued by Darul Ifta.

- Q. asalam-wali-kum, respected ulma's my grandfather/nana/mothers father birth-1922 were 2 brothers,whose father died at 1938.my nana inherited some property of his father but gave it to his only brother, but due to his hardwork, my nana made his own property .3 houses(residences) n numerous landed property from 1955-1988 till he died.now my nana left behind 2 sons n 1 daughter and a childless second wife.the elder son is divorced old in has so children.the 2nd son was settled in U.K n has 4 sons he died on 2000. the youngest daughter is married n has 3 grown up children.what is division of property among the children and childless 2nd wife of my nana according 2 sharia law.for 3 residences. n 10 plots of different value.

- Q. As explained previously that My wife died of Lung Cancer now the issue that exists is of the custody of child (only one boy just 11 months old)and property. Maternal Side: The Mother of my deceased wife is not alive, My deceased wife has two sisters ,one is elder & married ,younger one is unmarried .
