(1) If a person wishes to make up their lifetime qaza salah from and does not remember when they reached puberty (from puberty salah is fardh) then at what age should this person calculate from? (2) A person travels a Shariah distance i.e. 48 miles and intends to stay there for 15 days thus he will become a muqim but how are the 15 days to be calculated e.g. a person travelled on Sunday 29 October 2017 from his house and slept that night at his destination. Will this night be also calculated in his 15 days or will the nights commence on the night of Monday 30 October 2017?

(1) If the person showed no sign of adulthood such as ihtilam (nocturnal emission of semen) etc then as per the Shariah he shall be deemed to be adult from the age of fifteen years. However, if there is strong probability of puberty before the age of fifteen then he should abide by it. Thus he should make the qaza of all the salahs which he has missed by that time. If he does not have strong assumption then he should take the side of precaution. For example, he attained puberty at the age of 14 years whereas the other probably is that he attained it at the age of 14.5 then he should follow the first one and if it is true then alright otherwise the extra salah shall be deemed to be nafl.



 



بلوغ الغلام بالاحتلام والاحبال والانزال ....فإن لم يوجد فيهما شيئ فحتى يتم لكل منهما خمس عشرة سنة به يفتى . (الدر مع الرد: 9/ 225، 226 كتاب الحجر ط: زكريا ديوبند). من لا يدرى كمية الفوائت يعمل بأكبر رأيه فإن لم يكن له رأى يقض حتى يتيقن أنه لم يبق عليه شئ (حاشيه الطحطاوى على المراقى كتاب الصلاة باب قضاء الفوائت / 447.



 



(2) Those rulings in which the Shariah has taken year, month or day into consideration such as the duration of menstruating cycle, maximum duration of Nifas, duration of puberty, minimum time of tuhr, shaving of pubic hair, duration of masah on the Khuffain and the time period of breastfeeding etc therein the hour and minute shall also be taken into consideration. Likewise, hours and minutes shall also be counted during the time of iqamah for the traveler. Thus the time a musafir makes intention of iqamah from that time fifteen days i.e. 360 hours shall be calculated, for example a musafir intended to stay from 1 October at 12 o’clock to 16 October up to 12 o’clock then according to Shariah he shall be muqim.



 



المستفاد: وأقله ثلثة أيام بلياليها الثلاث فالإضافة لبيان العدد المقدر بالساعات الفلكية لا للإختصاص فلا يلم كونها ليالى تلك الأيام وكذا قوله: واكثره عشره بعشر ليال اهـ وفى الرد: قوله: "بالساعات" وهى اثنتان وسبعون ساعة الفلكية هى اللتي كل ساعة منها خمس عشره درجة وتسمى المعتدلة ايضا اهـ.
