    It is a condition that the slaughterer is a Muslim or follower of recognized creed; if he is not so, for example, he is a Hindu, Majusi or Qadiyani then the animal shall not be halal. And the second condition is that tasmia is recited at the time of slaughtering the animal. If he skips reciting tasmia knowingly then the animal shall not be halal. Yes, if he misses it unknowingly then there is no problem. If two people join the act of slaughtering in a way that two people jointly are hitting the knife or one of them is hitting the knife and the other one is supporting him in this act by putting his hand on his hand i.e. he is helping him in using the knife then in such a case tasmia is wajib on both of them. And if it is done only by one person and the other one is busy in holding the animal and bringing it down the earth then tasmia is not wajib on the other one. Moreover, there are four veins in the neck of the animal i.e. the windpipe (throat), food-tract (oesophagus) and the two jugular veins. According to Imam Abu Hanifah, may Allah have mercy upon him, the animal shall be halal if any three of the four veins are cut while slaughtering the animal. Whereas as per one saying of Imam Muhammad, may Allah have mercy upon him, it is necessary that the windpipe (throat), food-tract (oesophagus) and most part of the two jugular veins are cut. And this is said to be the most plausible opinion.  Hence it is better to adopt it. It is also a condition that the slaughterer is sane and if he is a mad or a child then his slaughtering shall not be halal.

    وأما شرطها فأربعة: الأول: آلة قاطعة جارحة والثانى أن يكون ممن له ملة حقيقة كالمسلم أو ادعاء كالكافر . (البحر الرائق زكريا 8/305) فمنها أن يكون عاقلاً فلا توكل ذبيحة المجنون والصبى الذي لا يعقل الخ (هدايه 5/285) والعروق التى تقطع فى الذكاة أربعة – فإن قطع كل الأربعة حلت الذبيحة وإن قطع أكثرها فكذلك عند أبي حنيفة وقالا : لا بد ان قطع الحلقوم والمرئى وأحد الودحبين والصحیح قول أبي حنيفة لما أن للأكثر حكم الكل وعن محد إذا قطع الحلقوم والمرئي والأكثر من كل ودجين يحل وما لا فلا وقال مشائخنا رحمهم الله وهو أصح الجوابات (هنديه 5/287) زكريا قديم
